I. Legal Advice and Registration of Copyright

We recommend you register your copyright with the United States Copyright Office. This provides additional legal protection and increased damages for some cases of copyright infringement. II. DMCA Takedown Request Procedure

If you believe a page on any Markee Dragon INC. owned website contains material or links to material that violates your copyrights, you MUST follow the procedure set forth below to notify us of claimed infringement and request the removal of said material or link.

We will begin investigating your claim as soon as possible, usually within 24 hours if received during normal business hours. If we receive multiple requests in a short amount of time, it will take us longer to respond to a request. Similarly, if we must consult legal representatives regarding the claim, it will take considerably longer to respond to a request.

III. Removal of Material or Links

If our preliminary investigation validates your claim, we will remove the referenced material or link.

II.a. Removal of Material

If we remove material stored on our servers (including posts within our forums) due to a DMCA Takedown Request, we WILL:

  1. Notify the poster of the removal
  2. Notify the poster that we believe the material to be infringing
  3. Notify the poster that they may make a counter-request (see II.c. DMCA Counter-Notices, below)

II.b. Removal of Links

If we remove a link due to a DMCA Takedown Request, we MAY perform any of the steps under II.a. Removal of Material, above.

II.c. DMCA Counter-Notices

If you wish to file a DMCA Counter-Notice, in response to a removal, you MUST follow the procedure set forth below, per 17 U.S.C. §512(g)(3):

1. Compose a reply email to our notification of removal containing the following:

  1. Your full name
  2. Your electronic AND physical mail addresses
  3. Your telephone number
  4. A detailed description of the removed material and where it appeared before removal, per 17 U.S.C. §512(g)(3)(B).
  5. A statement, under penalty of perjury, that you have a good faith belief that the removal was due to mistake or misidentification, per 17 U.S.C. §512(g)(3)(C).
  6. A statement of consent to submit to jurisdiction and service of process, per 17 U.S.C. §512(g)(3)(D).

When we receive your counter-notice, we WILL:

  1. Notify the originator of the takedown request of your counter-notice.
  2. Provide the originator of the takedown request with a copy of your counter-notice.
  3. Notify the originator of the takedown request that the removed material will be replaced in 10 to 14 business days, unless we receive notification that legal action is being undertaken, per 17 U.S.C. §512(g)(2)(C).

IV. Repeat Offenders

If we remove possibly infringing material from the same user more than 24 hours after notifying said user of a first case of removal of possibly infringing material, all permissions connected to our sites will be revoked for one week. If we remove possibly infringing material from the same user more than 24 hours after notifying said user of a second case of removal, all permissions connected to our sites will be revoked permanently.
